Hit by a drunk driver…

This story happened to a friend of mine just a few nights ago. She was with her friends, going to see the movie new moon. She doesn’t remember anything other than stepping into the crosswalk, and slamming down onto the pavement. She suffers a broken knee, possible break to the other leg, which requires surgery. Some cracked bones in lower back and her pelvis, a fractured femur, liver/kidney injuries, and several lacerations to her head which need plastic surgery.

The 16 year old female driver, was arrested on scene and charged with driving under the influence causing bodily harm then later released.

DUI in WA

I went to a friend’s place for a party and had one too many drinks, also forgot to have water before leaving for home. Got pulled over in a booze bust and breathed 0.12 blood alcohol content or something. I was drinking and driving, and they arrested me for a DUI. They put me in the bus and after 20 mins or so I was down to 0.09, which means I will lose my license for 3 months. Still waiting for the paperwork to arrive in the mail though. I am ashamed of what happened and it was my first offense (other than speeding fines etc.). I just got a new car too so I will be sad not to be able to drive it for 3 months.

Major League DUI

I was arrested for DUI after a major league baseball game. I had 4 20 oz. beers at the game on an empty stomach and then 2 martinis afterward – enough to elevate my BAC to over twice the legal limit. I had driven myself to the game to meet friends from work and had parked over a mile from the stadium. After leaving the bar I walked south and came upon a homeless man who was walking (stumbling) my way and picking flowers. I thought it strange that he didn’t ask me for change… he just wanted to walk and talk so I obliged. We walked and talked for almost 2 hours as I “sobered” up and provided him advice on how to get off the streets. At 9:30 pm I got into my car and offered to drive the man back into town as it was now dark and he needed to get downtown to the shelter. Shortly after I dropped him off my cell phone rang and my wife and kids were calling worried… they wanted me to bring home some ice cream. There was a heavy construction area along the downtown street I was traveling on and I did not see a flag person motioning me to stop as I navigated between the large traffic revision cones. As I moved around the revision an on foot officer knocked on my window and motioned me to pull over. I did so and he said that I had failed to stop for the flag person. He asked if I’d been drinking and I indicated that I’d had 4 beers at the game… but did not mention the martinis afterward. He called on the city DUI squad and I was administered the field tests which I performed “okay” on. After refusing the field breathalyzer test I was placed under arrest and taken to the basement of the city police headquarters where I was administered the Datamaster “official” BAC test. I registered .17 on the BAC test and the officer punched a hole in my driver’s license. He then gave me a ride home as he lived near my residence about 25 miles from downtown. I consulted with 8 lawyers but decided to represent myself and negotiate my own plea as opposed to rolling the dice with an attorney and paying $6-10K in attorney fees. I plead guilty to an under .15 DUI which requires a day in jail, $900 in fines, 1 year ignition interlock installed on my vehicle and a 90 day license suspension. I had driven a vehicle in worse condition over the past 20 years and was lucky not to have experienced a DUI in the past. Being part of the legal system really isn’t very much fun after not having a criminal record for over 40 years of my life. After getting a DUI I rarely drink and can’t drive with even a hint of alcohol in my system with the ignition interlock installed (breathalyzer to start your car). The ignition interlock is a useful thing, but it is quite annoying and embarrassing. Though it would be best if no one drove after drinking the fact is that leaving every restaurant and bar every night there are numerous potential DUI offenders – Before this happened to me I wouldn’t hesitate to share a bottle of wine at dinner or a pitcher of beer with a friend after work then drive home. As a convicted DUI offender, the consequences of receiving another DUI are severe with 30 days mandatory jail time in my state.

I didnt get a DUI

I got pulled over for not having my headlights on. I was in my buddies truck and the he was wasted and I was drunk. I did the field sobriety test and i guess i passed. I didn’t do my ABCs right but passed everything else. He let us go without giving me a DUI now its just mind blowing how he let me go. I was completely honest the entire time and told him I had been drinking. I don’t know how the heck I didn’t go to jail.

I was going home after having two beers at a bar. I ran a red light I failed on field test and then blew and only had a 0.054. He arrested me on the ground that didn’t follow direction and put my foot wrong on the line test. Every thing eles was perfect. I got a DUI

The Cop Lied About my DUI

This story happened in 2007.

When I got I Dui I was taking some girl down to the bar to pick up one of her friends. I pulled up behind  the bar in the alleyway and hit the curb stop behind the rooftop bar in downtown Bozeman, MT.  At that point an officer was pulling through the alleyway.  He saw me hit the curb stop and reversed toward me.  At that point I got out of the vehicle with the girl and started walking rapidly toward the rooftop bar.  About half way up the stairs I heard a really loud voice say “get back to the vehicle”. I tried to get into the passenger side of the vehicle and say that I was not driving. He said that he had seen me get into the driver’s side.  I got back into the driver’s seat of the vehicle I was questioning the officer as to why he was pulling me over. He stated that I hit the brick wall that was three feet in front of the parking curb. (I was driving my roommates Nissan Maxima so there was no way I could have jumped over the parking curb and rolled three feet into a brick wall without doing damage to the car.) The officer then began his questioning. From this point it really got bad. He gave me the foot test and the abc test which I was not doing very well with to say the least. He made me blow into a breathalyzer.  I blew a 0.18% bac.   The officer arrested me and took me into the “drunk tank” (jail). They didn’t have enough room to hold me so I had to schedule another 24 period to spend in jail as part of my punishment.  My friend then came and picked me up thank god.

I went to court and paid $3500 dollars in lawyer fees trying to fight the DUI.  I did not hit a brick building and they did not have reasonable cause to pull me over. It turned out that when the trial came around there was around there 1 minute to when my charges would have been dropped because no cops had show up. Right before the cutoff around 10 cops entered the room. Even the lady who calibrated the breathalyzer was there.   If I wanted to go trial it was going to cost me a lot more money so I plead guilty. It was $3500 in DUI lawyer fees, $800 for the DUI, $150 for DUI classes, $100 for a work permit, and $100 for a reinstatement fee. The total money I spend was $4,650.  I lost my real license for six months but I got a work permit to drive to work. My insurance never got raised because they didn’t randomly pull my driver record. A word to the wise: don’t try to shop insurance during this process because you will get screwed over paying high fees.

The best part of the story was the girl I was with was still waiting for me at my house after this whole thing went down.

fatal accident

My brother was killed by a drunk driver in 2007. He was on his way home from work, driving on highway 85 when all of a sudden a drunk driver hit him head on. He was driving on the wrong side of the interstate with no lights on, and my brother didnt see him. This happened at 3am. They both died instantly but to this day i still can not grasp the fact that my big brother is dead. He left a baby and wife behind. I HATE drunk drivers!!!!!!!

arrested

I was pulled over, and the cop asked me “are you in a hurry?” I replied “No” and he told me I had run two red lights. I took the FST and failed. I was taken to the police station, where they gave me a breathalyzer. I was over 0.08. I was taken to jail, and not I’m trying to figure out where to go from here.

I didn’t have my headlights turned on, and failed the field sobriety test miserably. I did get it reduced to a low tier dui from a high tier dui, and was able to negotiate a few other privileges.

dui cough syrup

I had my girl with me in my car on my way home from her house I just took prescription cough syrup that says it has alcohol i told the cop he said he didn’t care and put the breathlyzer in my face I told him no id rather take a blood test I spent the night in jail and still don’t know what my blood level reading was.
